KOZJANSKO REGIONAL PARK

The Kozjansko park was established by THE TREBČE MEMORIAL PARK ACT which was published in the Official Gazette of the SRS, No. 1/81.

Protected areas, biodiversity conservation measures, and the system for the protection of natural values are defined by the NATURE CONSERVATION ACT.

 The STATUTES OF THE KOZJANSKI PARK PUBLIC INSTITUTE shall regulate and define: the basic provisions, the activities and bodies of the Institute and their competences, the methods of decision-making, the rights, duties and obligations, the method of obtaining and using funds, and other relations relevant to the functioning of the Institute.

CONSENTS, PERMITS, OPINIONS, AND PRE-EMPTION RIGHTS

In areas with a special status under nature conservation legislation (Natura 2000 sites, protected areas, and areas of national or local natural value), the sale of land, construction of buildings, and human interventions must be subject to the required consents or opinions.

Sale of land – ESTABLISHMENT OF PRE-EMPTION RIGHTS

In the case of the sale of agricultural, water or forest land located in an area protected by the State, the pre-emption beneficiary and the protected area operator must be notified by making them an offer for the sale of the land in the protected area in accordance with Article 84 of the Nature Conservation Act.

The pre-emption right of the State is exercised by the Ministry of Natural Resources and Spatial Planning.

Encroachment into nature – ENVIRONMENTAL ENCROACHMENT PERMIT

For interventions in nature that may endanger biodiversity, a natural value or a protected area (e.g. maintenance work on watercourses, mulching of overgrown areas, etc.), and which do not require a permit under the spatial planning regulations or other regulations, an authorisation for intervention in nature must be obtained in accordance with Article 104 of the Nature Conservation Act issued by the competent administrative unit.

Construction of a building subject to planning permission – NATURE PROTECTION CONDITIONS AND EXPERT OPINION

In the case of construction of a building for which a building permit is required (simple, less complex, and complex buildings) in an area which has a special status under the nature conservation regulations (Natura 2000 sites, protected areas and areas of natural values of national or local importance), it is necessary to obtain nature conservation design and other conditions, and an expert opinion from the Institute of the Republic of Slovenia for Nature Conservation in accordance with Article 105 of the Nature Conservation Act.

A request for conditions and an opinion shall be submitted to the competent regional unit of the Institute of the Republic of Slovenia for Nature Conservation.

Construction of a building not subject to planning permission – NATURE PROTECTION CONDITIONS AND CONSENSUS

In the case of construction of a building for which a building permit is not required (e.g. simple buildings) in an area which has a special status under the nature conservation regulations (Natura 2000 sites, protected areas and areas of natural values of national or local importance), nature conservation conditions and nature conservation consent must be obtained from the Ministry of Natural Resources and Spatial Planning in accordance with the Building Act.
